James E. Figliozzi
Counsel
Mr. Figliozzi concentrates his practice on Title IX, college discipline, and defamation matters.
He has experience representing students before school tribunals as well as state and federal courts nationwide in matters involving academic dishonesty, harassment, sexual misconduct, due process violations, and various forms of discrimination.In 2022, Mr. Figliozzi served as second chair on the trial team that obtained a unanimous $5,300,000 jury verdict for a former Clemson student who was falsely accused of rape. Based on findings of liability against three defendants for defamation and civil conspiracy, the award constituted one of the largest verdicts ever achieved in a matter involving a private individual in that area of the state. During this litigation, Mr. Figliozzi also assisted in preparing a writ to the Supreme Court of South Carolina, which ultimately determined that special referees lacked jurisdiction to oversee discovery in civil matters, ending the lower courts’ longstanding but improper practice of delegating such authority.
Before joining Warshaw Burstein, Mr. Figliozzi developed wide-ranging litigation experience representing individual and corporate clients in state and federal courts, mediations, arbitrations, and appeals at another mid-size firm in Manhattan. After law school, he served as a law clerk for the Chief Judge of the United States Court of Appeals for Veterans Claims in Washington, D.C.
